These Terms and Conditions (“Terms”) govern your access to and use of the-hyve (“the-hyve,” “we,” “us,” or “our”), including our mobile application, website, and related services (collectively, the “Services”).

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy, Cookie Policy, and Community Guidelines, which are incorporated by reference.

If you do not agree, you must not use the Services.

1. Relationship to Other Policies

1.1 Integrated Policies: These Terms operate together with:

  • Privacy Policy (how we collect, use, and protect personal information)
  • Cookie Policy (how cookies and similar technologies are used)
  • Community Guidelines (behavioural expectations and safety standards)

In the event of any inconsistency, the Privacy Policy governs personal data handling, and the Cookie Policy governs tracking technologies.

2.2 Account Accuracy: You agree to provide accurate and up-to-date information and to keep your account secure.

2.3 Account Responsibility: You are responsible for all activity under your account. Notify us immediately of unauthorized use.

3. Use of the Services

3.1 License Grant: We grant you a limited, non-exclusive, revocable, non-transferable license to use the Services for personal, non-commercial purposes.

3.2 Prohibited Uses: You agree not to:

  • Misrepresent your identity
  • Circumvent safety, consent, or security features
  • Harass, intimidate, or discriminate against others
  • Misuse reporting or safety tools
4. Events and Real-World Participation

4.1 Voluntary Participation: All events are optional and attended at your own discretion.

4.2 No Guarantee of Outcomes: the-hyve facilitates introductions and recommendations but does not guarantee outcomes, compatibility, or experiences.

4.3 Safety Expectations: You agree to follow:

  • Event-specific instructions
  • Host or co-host guidance
  • the-hyve’s Community Guidelines

Failure to do so may result in restriction or removal from the platform.

5. Safety Tools and Reporting

5.1 Use of Safety Features: the-hyve provides safety and reporting tools to support community well-being.

5.2 Good-Faith Use: You agree to use reporting tools honestly and responsibly. False or abusive reports may result in account action.

5.3 Data Handling: Safety reports are handled in accordance with our Privacy Policy and are accessed only by authorized personnel.

6. Personalization and Recommendations

6.1 Consent-Based Personalization: Personalized recommendations are provided only with your consent, as detailed in our Privacy Policy and AI Ethics disclosures.

6.2 Opt-Out Rights: You may opt out of behavioural personalization at any time without losing access to core functionality.

6.3 No Sensitive Inference: the-hyve does not infer or use sensitive personal traits.

7. Payments and Fees

7.1 Paid Features: Some Services may require payment. Pricing and refund terms will be clearly presented at the point of purchase.

7.2 Third-Party Payment Providers: Payments are processed by third-party providers subject to their own terms and privacy practices.

7.3 Taxes: You are responsible for applicable taxes unless otherwise stated.

8. Intellectual Property

8.1 Our Content: All intellectual property in the Services belongs to the-hyve or its licensors.

8.2 User Content License: By posting content, you grant the-hyve a non-exclusive, royalty-free license to use that content solely to operate and improve the Services, consistent with our Privacy Policy.

8.3 Restrictions: You may not copy, reverse engineer, or exploit the Services without permission.

9. Cookies and Tracking Technologies

Use of cookies and similar technologies is governed by our Cookie Policy.

11. Limitation of Liability

To the maximum extent permitted by law:

  • the-hyve is not liable for indirect or consequential damages
  • Our total liability is limited to amounts paid (if any) in the previous 12 months

Nothing in these Terms limits rights that cannot be excluded under Canadian law.

12. Indemnification

You agree to indemnify and hold harmless the-hyve from claims arising from your misuse of the Services or violation of these Terms.

13. Termination

We may suspend or terminate access where:

  • These Terms are violated
  • Safety risks arise
  • Required by law

You may stop using the Services at any time.

14. Governing Law and Dispute Resolution

14.1 Governing Law: These Terms are governed by the laws of Ontario and Canada.

14.2 Dispute Resolution: Disputes will be resolved through confidential arbitration in Ontario, where permitted by law.

15. Changes to These Terms

We may update these Terms periodically. Material changes will be communicated, and continued use constitutes acceptance.
